Tree Maintenance
There are hundreds of properties throughout the town with trees and other vegetation encroaching into streets and sidewalks and limbs that block signs and signal lights. These tree limbs are hazards and can force vehicles into other lanes, force pedestrians and cyclists into the streets, and can cover important signage. If an accident occurs due to the encroaching vegetation, the town would not be at fault, but rather the property owner would assume responsibility. Therefore, regular maintenance on resident owned vegetation is vital to the health and safety of the town.
13.54.040 – Property owner responsibility.
A. It is the responsibility of the property owner to maintain all trees on his or her property. The property owner must ensure that the trees on his or her property do not pose a danger to his or her own property or the property of others. Property owners have the burden of demonstrating compliance with this chapter.
B. Property owners that do not maintain trees on their property and, as a result, create an emergency, will be subject to the provisions of Section 13.54.170. (Ord. 252 § 1, 2014)
